The new Law Society’s Climate Change Risk Property Practice Note provides essential & specific guidance for solicitors handling property transactions. But how do you ensure you address & advise clients, whether residential or commercial, on climate change risks proportionately, in practice?

Simon Boyle, Environmental Lawyer with Landmark Information has provided a technical supplementary note, together with Landmark colleagues, around climate risks for the Law Society Practice Note and in this practical session will share:

  • What to consider as a matter of good practice when acting for your client in particular transaction types.
  • Compliance with professional duties
  • Ensuring informed advice to clients –
    • How to understand the climate risk data and assessment results within a search report
    • What constitutes a ‘Physical’ risk and a ‘Transition risk’
    • The RCP, timeline, and risk analysis adopted by the climate search
    • Mitigation of potential risks
  • How to consider these various factors to advise or warn your client appropriately to potential climate risks. Simon will provide examples of different result scenarios to demonstrate.
  • Scope of solicitor advice on climate risk at point of terms of engagement and report on title
  • Guiding how clients can get specialist climate advice.

Simon Boyle, Environmental Lawyer – Legal Director, Landmark Information

Simon has over 25 years’ experience as an environmental lawyer which has included working in local government and for a major manufacturing company. For 12 years he has run an MSc module on Environmental Policy and Law.
