The Law Society has issued a formal response following the recent Court of Appeal judgment in CILEX v Mazur.

While many within the profession will already be familiar with the case and the coverage it has received in the legal press, the judgment is an important development, providing clarification around rights of audience and the conduct of litigation.

In its response, the Law Society has highlighted the need for clear and consistent guidance for the profession and has confirmed a number of next steps. These include updating its existing practice note to reflect the implications of the judgment and arranging a webinar to support members in understanding the practical impact and to provide an opportunity to raise questions.

The Law Society is also engaging with the Solicitors Regulation Authority regarding the further guidance that will be required, and liaising with CILEx to help ensure a consistent approach across the professions.
