Civil Justice Council Consultation: Use of AI in Preparing Court Documents

The Civil Justice Council has published an interim report and consultation examining whether procedural rules should be introduced to govern the use of artificial intelligence by legal representatives when preparing court documents.

As AI continues to evolve rapidly, the consultation explores how innovation can be balanced with professional obligations and the need to maintain confidence in the administration of justice.

Although focused on documents created for the court, the issues raised reflect broader developments in legal practice and professional accountability.

What is being proposed?

The consultation considers a range of potential measures, including:

  • Whether legal representatives should declare when AI has been used in documents submitted to the court
  • A proposed requirement confirming that AI has not been used to generate the content of trial witness statements
  • Possible obligations for experts to identify and explain any AI used in preparing reports
  • Whether existing professional responsibilities provide sufficient safeguards without additional rules
