Court of Appeal Judgment in Mazur – Law Society Update

The Law Society has issued an updated Practice Note following the Court of Appeal judgment in CILEX v Mazur, providing guidance on the conduct of litigation and the role of authorised and non‑authorised individuals within legal teams.

While many within the profession will already be familiar with the case and the coverage it has received in the legal press, the judgment is an important development, offering clarification around rights of audience and the conduct of litigation.

The updated Practice Note sets out how solicitors, law firms and legal businesses can ensure that only those authorised to do so carry on the conduct of litigation. It also provides helpful guidance on the activities that non‑authorised team members may undertake, either in their own right or under appropriate supervision.

The Law Society also held a webinar on 14 April to support members in understanding the practical implications of the judgment. A recording will be made available shortly.
