Course outline

Flats let on long leases present a range of risks and responsibilities for conveyancers handling leasehold purchases. Many of these risks are embedded in the specific terms and conditions of flat leases, which vary significantly since there is rarely a one-size-fits-all template for every apartment.

This practical seminar is designed for conveyancers involved in the purchase of leasehold flats. Its key objective is to help you understand the major elements of a flat lease and their practical implications, so you can advise your buyer clients confidently. The session includes real-life examples of problematic lease provisions and scenarios where lease terms were not properly followed, highlighting lessons that can be applied in everyday practice.

Issues covered by this presentation will include:

  • Accuracy of flat descriptions – including boundaries, common parts, and structure.
  • Maintenance, repair, and insurance – assessing whether arrangements are clearly and adequately addressed.
  • Tenant alterations – understanding the scope and limits of permitted changes.
  • Service charge provisions – spotting obvious flaws or ambiguities.
  • Curing lease defects – evaluating if, how, and to what extent identified issues can be remedied.
  • Real-life examples of problematic lease clauses – illustrating practical implications and lessons from actual cases.

Stephen Desmond

Since 2004, Stephen Desmond has delivered more than 1,900 CPD events to lawyers from a variety of backgrounds, with a particular focus on flat and apartment leases and practical solutions.  Delegates at these events have included practitioners from a variety of size of firms, ranging from sole practitioners to City Solicitors.

Stephen is a contributing editor to Butterworths Property Law Service, writing on the complex law relating to long and short leases.  He has written for a monthly publication on the subject of commercial property. He also once ran a university-accredited distance-learning course for aspiring paralegals in the subject of residential conveyancing.

A non-practising Solicitor with several years post-qualification experience, Stephen has represented many business and private clients, including property investors and local authorities.
