The introduction of additional safeguards and a streamlined process for Lasting Powers of Attorney (LPAs) will mark a significant shift in how these vital documents are created and managed. This course will explore the government’s plans to make the LPA process predominantly digital while retaining and enhancing the paper system for those who require it. Participants will learn about the critical changes requiring donors to register LPAs themselves, a measure designed to protect vulnerable individuals from undue influence. The Office of the Public Guardian (OPG) will now take on the responsibility of verifying the identities of all parties involved, adding a vital layer of security.

The session will also cover new developments that allow chartered legal executives to certify LPAs, broadening access to professional advice. Errors made during the registration process can be corrected online, making the process more efficient. Additionally, the course will examine the expansion of rights for a larger group of interested persons to raise objections if they suspect abuse or fraud in the appointment of an attorney, as well as removing attorneys and the process to prevent abuse of a vulnerable person.

With practical insights and expert guidance, attendees will leave equipped to advise clients effectively in light of these upcoming reforms.

 

Helen Forster

 

Helen Forster is the Managing Director of the firm HTF Legal and is a solicitor and Trusts and Estates Practitioner. Since qualifying in 2009, she has specialised in Wills, Probate, Trusts, Tax and Court of Protection matters. She is also a Dementia Champion with Age UK, a member for Solicitors for the Elderly and also a member of STEP (The Society of Trusts and Estates Practitioners).

Her other work includes seminars, lecturing and training throughout the Country with institutions such as regional Law Societies and MBL Seminars Limited, as well as providing in house training to firms on a number of subjects.

Helen also teaches night classes at Rossett School Adult Learning in Harrogate, giving individuals an insight into how legal documents such as Lasting Powers of Attorney are drafted, as well as pitfalls and problems.

Over her career she has been highly commended twice in the Yorkshire Legal Awards, as well as receiving an award for second place in the Modern Law Awards 2016 in the category of “Rising Star” in England and Wales. Helen was also shortlisted for “Managing Partner of the Year” in the Yorkshire Legal Awards 2023. Her firm was Highley Commended in the British wills and probate awards for boutique law form of the year.
